Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and Wethook Guide Service (“Wethook,” “we,” “us” or “our”), operated by Captain Carl Bostick. They apply to your use of wethook.com (the “Site”) and to any fishing trip, bird watching trip, lake tour or custom trip you book with us (a “Trip”).
By using the Site, booking a Trip or coming aboard, you agree to these Terms. If you book for a group, you agree on behalf of everyone in your party and confirm you have shared these Terms with them. You must be at least 18 to book.
Our services
We offer guided fishing trips, bird watching and sightseeing tours, and custom trips on Lake Conroe, Texas, aboard our 24-foot pontoon boat, Miss Donna. Trips leave from Seven Coves Marina, 6989 Kingston Cove Ln, Willis, TX 77318, unless we tell you otherwise. Trip lengths, inclusions and details are described on the Site and on the booking page at the time you book.
We provide rods, reels, tackle, bait (when needed) and required safety equipment. Fish cleaning is not included; an optional third-party cleaning service at the marina is available for an additional fee. Guests bring their own fishing licenses, drinks, snacks, an ice chest for their fish and clothing for the weather.
We do our best to find fish, but fishing is never guaranteed. Wildlife sightings on tours are not guaranteed either. Results depend on nature, and no refund is owed because fish didn’t bite or wildlife didn’t appear.
Booking and payment
- Trips are booked through our online booking page, run by Acuity Scheduling, or by calling us.
- A $100 non-refundable deposit is required to hold your date, except as described in Rescheduling and Weather below.
- The remaining balance is due 24 hours before your Trip, unless we agree otherwise.
- Your booking is confirmed when you receive a confirmation from the booking system or from us.
- You agree to give accurate information when you book, including your contact details and the number of guests.
- Payments made online are processed by the payment provider connected to our booking page, under its own terms. We accept all major cards, Apple Pay, cash, Venmo, Zelle and Cash App.
- Custom, group and corporate trips are priced by agreement with the captain. You confirm and pay the agreed amount through the “Custom Event” booking using “Pay what you want.”
- Gift cards are digital and are delivered as a printable certificate with a redemption code. They can be applied to any Trip booked online, can be put toward a higher-priced Trip with the difference paid by the guest, and do not expire.
- Tips for the captain are appreciated but never required.
Prices
Current prices are shown on the Site and on our booking page, and the price that applies to your Trip is the one shown when you book. We may change prices at any time, but changes won’t affect Trips that are already confirmed. If a price is shown in error, we will contact you to fix it before your Trip, and you may cancel for a full refund if you don’t accept the correct price.
Rescheduling and cancellations
- You may reschedule your Trip up to 5 days before your scheduled date at no charge, subject to availability. Your deposit moves to the new date.
- Requests made less than 5 days before the Trip may be treated as a cancellation, and the deposit may be kept.
- If you cancel, your deposit is non-refundable except as stated in these Terms or as required by law. Any amount paid beyond the deposit will be refunded if you cancel at least 24 hours before your Trip.
- If we have to cancel for a reason other than weather (for example, boat trouble or illness), you may choose to reschedule or receive a full refund of what you paid.
Weather and safety calls
Your safety comes first. Captain Carl decides whether conditions are safe, including lightning, high wind, heavy rain, fog, extreme temperatures or lake conditions. He may delay, shorten, move or cancel a Trip, before or during it, if he believes conditions are unsafe.
- If we cancel for weather, you may reschedule at no charge.
- If you are not local to the Lake Conroe area and we have a bad-weather day, you may have your Trip refunded.
- Light rain, cold or wind alone may not mean a Trip is canceled. Fishing often stays good in less-than-perfect weather. Bring clothing for the forecast.
- If a Trip is shortened for safety after it starts, we will work with you on a fair partial credit or reschedule at the captain’s discretion.
- If you choose not to go when the captain considers conditions safe, normal rescheduling and cancellation terms apply.
Late arrivals and no-shows
Please arrive at the marina on time. Trips start at the scheduled time, and late arrivals may shorten your Trip without a discount so we can stay on schedule for other guests. If you are more than 30 minutes late without contacting us, or don’t show up, we may treat it as a no-show, and the full Trip price may be charged.
Party size
Our boat carries up to 7 guests, not counting the captain. This limit is for safety and will not be exceeded. Children and infants count toward the total. Tell us the correct number of guests when booking. For groups larger than 7, call us to arrange additional boats or trips.
Fishing licenses and regulations
- Texas requires a valid fishing license with a freshwater endorsement for anyone 17 or older who fishes. Each guest is responsible for buying their own license from the Texas Parks and Wildlife Department before the Trip and having it available on board.
- Guests without a required license may not fish. No refund is given for a missing license.
- All fishing follows Texas Parks and Wildlife bag, size and possession limits. The captain may require fish to be released to comply with the law or to protect the fishery.
- You are responsible for any fines resulting from your own violations.
Safety rules and captain’s authority
- The captain is in charge of the boat and has final say on all safety matters. Please follow his instructions at all times.
- U.S. Coast Guard–approved life jackets are on board for every guest. Children under 13 must wear a life jacket at all times while the boat is moving, and we may require any guest to wear one.
- Stay seated while the boat is moving, keep hands and feet inside the boat, and be careful with hooks, lines, fins and fish spines.
- Swimming from the boat is not allowed unless the captain says otherwise.
- The captain may end a Trip early, without a refund, if a guest’s behavior puts anyone at risk or breaks these Terms or the law.
Guest conduct, alcohol and prohibited items
- Be respectful to the captain, other guests and other people on the lake.
- Alcohol is allowed only in moderation and only if the captain permits it. Intoxicated guests may be refused boarding or returned to the dock without a refund. Glass containers are not allowed on board.
- Illegal drugs, weapons and fireworks are not allowed on board.
- Smoking and vaping are allowed only where and when the captain allows.
- Pets are not allowed unless approved in advance.
- You are responsible for any damage to the boat or equipment caused by you or your party beyond normal wear and tear, including lost or broken rods and reels due to misuse.
Children and minors
Kids are welcome. Every guest under 18 must be accompanied and supervised by a parent, guardian or responsible adult who agrees to these Terms on the minor’s behalf and is responsible for the minor’s conduct and safety.
Health and fitness
Trips involve sun, heat, wind, motion and time on the water. Tell the captain before the Trip about any medical conditions, allergies, pregnancy, mobility needs or swimming limits that may affect your safety. Bring any medication you may need. You are responsible for deciding whether you are fit to take part. The boat is about one-third covered by a Bimini top, so sunscreen, hats and water are strongly recommended.
Assumption of risk
Boating, fishing and being outdoors carry risks that can’t be fully removed, even with care. These include slips and falls, hooks and sharp equipment, fish spines and teeth, sudden weather changes, sun and heat exposure, insects and wildlife, wakes from other boats, mechanical problems, and the risk of falling into the water or drowning. By booking or coming aboard, you understand these risks and voluntarily accept them for yourself and any minors in your care, to the fullest extent allowed by Texas law.
Release and indemnity
To the fullest extent allowed by law, you release and agree not to hold Wethook Guide Service, Captain Carl Bostick and our crew, agents and marina partners (the “Wethook Parties”) responsible for injury, illness, loss or damage arising from the ordinary risks of a Trip, except where caused by our gross negligence or willful misconduct. You agree to defend and pay for claims brought against the Wethook Parties that result from your (or your party’s) breach of these Terms, violation of law or reckless conduct. We may ask guests to sign a separate written release before boarding.
Limitation of liability
To the fullest extent allowed by law, the Wethook Parties are not liable for any indirect, incidental, special or consequential damages, such as lost travel costs, lodging or lost enjoyment, arising from a Trip or the Site. Our total liability for any claim related to a Trip or the Site will not be more than the amount you paid us for that Trip. Nothing in these Terms limits liability that cannot be limited under Texas or federal law, including liability for gross negligence or willful misconduct.
Personal property
You are responsible for your personal belongings, including phones, cameras, sunglasses, keys and wallets. We are not responsible for items that are lost, stolen, damaged or dropped in the lake. Waterproof bags are a good idea.
Catches and fish cleaning
Fish cleaning is not included in the trip price. If you’d like your legal catch cleaned, a third-party fish cleaning service at Seven Coves Marina offers it for an additional fee that you pay directly to that service, under its own terms. Bring an ice chest to take your fish home. Once fish are handed to you, you are responsible for storing and transporting them safely. We may release fish that are undersized, over the limit or that we believe should be released.
Photos and media
The captain may take photos and short videos during Trips. You agree that we may use them on the Site, in our gallery and on our social media pages, without payment to you. If you don’t want photos of yourself or your children taken or shared, tell the captain before or during the Trip, and we will respect that. You can also ask us to remove a posted photo at any time. See our Privacy Policy.
Use of this website
You may use the Site for personal, lawful purposes such as learning about and booking Trips. You agree not to misuse the Site, including by trying to hack it, disrupt it, copy it in bulk with automated tools, or use it to send spam. We try to keep information on the Site accurate and current, but trip details, availability and other information may change and the Site may contain errors. The Site is provided “as is” and “as available,” without warranties of any kind to the extent allowed by law.
Website content
The Site’s text, photos, illustrations, logos and design belong to Wethook Guide Service or are used with permission. “Wethook” and our logo are our trademarks. You may share links to the Site, but you may not copy or reuse our content for commercial purposes without written permission. Fish illustrations on the Site are for identification only.
Third-party services
Booking and payments are handled through Acuity Scheduling and its payment processor, and the Site links to services like Google Maps, Facebook, YouTube and TikTok. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, but we’ll help sort out any booking problem with you.
Governing law and disputes
These Terms are governed by the laws of the State of Texas and applicable federal maritime law, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try to resolve the issue informally for at least 30 days. Any lawsuit related to a Trip or the Site must be brought in the state or federal courts located in or serving Montgomery County, Texas, and you agree to the jurisdiction of those courts. To the extent allowed by law, any claim must be brought within one (1) year after it arises.
Other terms
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer your booking or these Terms without our consent. These Terms, together with our Privacy Policy, Cookie Policy, any confirmation you receive and any written release you sign, are the entire agreement between you and us about your Trip and the Site. We are not responsible for delays or cancellations caused by events outside our control, such as severe weather, lake closures, government orders, fuel shortages or emergencies.
Changes to these terms
We may update these Terms from time to time by posting a new version on this page and changing the “Last updated” date. The Terms in effect when you book apply to that booking, unless a change is required by law or for safety.
